By marking in the «I Agree» field accompanied by a reference to this Policy, you (hereinafter also the User) freely, by your will and in your interests, give your written consent to the processing of Personal Information in the manner and under the conditions established by this Policy.
1. General provisions
1.1. This Policy is an integral part of the User Agreement (the «Agreement») posted and/or available on the Internet at https://global.flowers/en/legal/agreement/ and other agreements entered into with the User when expressly provided for in their terms. Thus, by entering into the Agreement and the said agreements in the manner set forth therein, including the use of the Annex, you agree to the terms of this Policy in full.
1.2. Methods of processing Personal Information include any actions (operations) or combination of actions (operations), including, collection, recording, systematization, storage, refinement, retrieval, use, transfer, depersonalization, blocking, removal, destruction for the purposes set forth in this Policy, using or without the use of such means at the discretion of Global Flowers.
1.3. Hereinafter, the Policy shall use terms and definitions provided for in the Agreement as well as other User contracts, unless otherwise provided for in this Policy or derived from its substance. Otherwise, the term used in the Policy shall be interpreted in accordance with applicable law, business practices, or scientific doctrine.
2. Personal information
2.1. Personal Information in this Policy shall mean:
2.1.1. Information that the User provides about himself or herself during registration or authorization, as well as during further use of the Application and/or the Service, including personal data of the User.
2.1.2. Data that is transmitted automatically depending on the settings of the User's software in an impersonal form.
2.2. Global Flowers has the right to establish the requirements for the composition of the Personal Information of the User, which must be provided for the use of the Application and the Service based on it. If certain information is not marked as mandatory by Global Flowers, it shall be made available or disclosed by the User in its sole discretion.
2.3. When the User registers, the account name (login), email address and password must be specified.
When registering, Global Flowers creates a unique identifier for each Account (USER_ID). The Account ID is bound to the Account profile information.
For the purposes of concluding Contracts, the User may also provide the following personal data about himself: name, position, telephone number.
If an individual acts in the interests of the organization, the name, TIN, CPT, OGRN, registration address and postal address of such organization, corporate telephone number, settlement account, name of the servicing bank, its BIC and correspondent account may be additionally provided. This organization information does not apply to personal data.
If an individual acts as an individual entrepreneur or in his interests, at the request or with the direct written consent of such an individual entrepreneur, respectively, the following may be additionally provided: the surname and initials of the individual entrepreneur, TIN, OGRNIP, and the address for correspondence, telephone number, account, name of the servicing bank, its BIC and correspondent account.
2.4. Public information. At your discretion, in order to complete the profile in the Service, the User may also provide the following personal data about himself: last name, first name, patronymic, gender, date of birth, city of location, place of work, position, information about himself in free form. By adding information to the profile, the User makes such information accessible to an unlimited number of persons, that is, publicly available, taking into account the settings for displaying profile information in the Service.
2.5. Global Flowers does not verify the authenticity of the Personal Information provided and the User has the necessary consent to process it in accordance with this Policy, believing that the User acts in good faith, prudently and makes all necessary efforts to maintain such information in an up-to-date state and obtain all necessary consents of personal data subjects.
2.6. Global Flowers collects and stores User activity data in the Service using log files. If the actions are performed by an authorized User, such information is associated with the User ID.
2.7. The User understands and accepts the possibility of using the third-party software on the Site and in the Mobile Application, as a result of which such persons may receive and transmit the data specified in Clause 2.1.2 in an impersonal form.
The specified third-party software includes:
- analytic data collection systems: Google Analytics, Yandex.Metrics, Yandex AppMetrica.
- analytics tools (pixels) of social networks: Facebook, VKontakte;
- advertising systems: Google DoubleClick for Publishers (DFP), Google Adsense, Yandex Advertising Network (RSIA), Criteo;
- anti-spam systems: Google reCAPTCHA.
The composition and conditions for the collection of impersonal data using third party software are determined directly by their rights holders and may include:
- browser data (type, version, cookie);
- operating system data (type, version, screen resolution);
- request data (time, transition source, IP address).
- other impersonal data on the User's actions in the Application.
2.8. As part of the provision of certain types of services, Global Flowers may provide Users with the opportunity to independently place on separate pages of the Site software for collection and processing of impersonal data similar to those specified in Clause 2.7. of this Policy, as a result of which such Users may receive the data specified in paragraph 2.1.2 in an impersonal form. The composition and conditions for the collection of impersonal data in such case shall be determined by the User who has placed the software for the collection and processing of impersonal data, but may not conflict with this Policy.
2.9. Global Flowers shall not be responsible for the procedure of using the Personal Information of the User by third parties with whom the User interacts within the framework of using the Application and/or the Service.
3. Legal grounds for processing Personal Information
3.1. The legal grounds on which Global Flowers uses Personal Information include:
3.1.1. Processing of Personal Information when the User has consented to processing for one or more specific purposes;
3.1.2. Processing of Personal Information when necessary for the execution of the contract to which the User is a party;
3.1.3. Processing of Personal Information when required to enter into a contract with the User;
3.1.4. Processing of Personal Information required for Global Flowers to perform its obligations under applicable law.
4. Child policy
4.1. Global Flowers does not intentionally collect personal data from children under the age of 18 years, does not request it and does not allow them to use the Application. Persons under 18 years of age are not allowed to provide personal information, including name, address, telephone number and email address. If Global Flowers becomes aware that information was received from a child under the age of 18, Global Flowers will immediately delete such information. 5. Purposes of Personal Information Processing
5.1. Global Flowers processes, including the collection and storage of the Personal Information required for the conclusion and execution of User contracts, and is made publicly available by the User by filling in the profile and setting the settings in the Personal Account.
5.2. Global Flowers may use the Personal Information for the following purposes:
5.2.1. Implementation of the Service functionality to create and display the User profile in the Application. Global Flowers stores, organizes and displays in the Application User profiles containing Personal Information, which Users have made publicly available.
5.2.2. Entering into contracts for the use of the Application and the Service; The Agreement is concluded remotely through the exchange of electronic documents, which are signed by a simple electronic signature. At the same time, the role of the key of the simple electronic signature of the User can be performed by a pair of login - password or its email address. Therefore, they are requested at registration.
5.2.3. Fulfillment of obligations under the concluded contracts, including granting the User access to the Application and Service; Requests for access to the Service are accepted using the Application software and email.
5.2.4. Identification of the User as part of fulfillment of obligations under the agreements concluded with it; The Account's personal account is associated with the Account's login password and email address.
5.2.5. Providing technical support in connection with the Application and Service; Support calls are accepted using the Application and email tools.
5.2.6. Provision of communication with the User for the purposes of information service and improvement of the Service quality under the concluded Agreements, including in the order of notification with the involvement of third parties; Communication with the User is carried out via email or by telephone number specified by the User at registration or during use of the Application and/or the Service.
5.2.7. Use of impersonal data to target advertising and/or information materials by age, sex, other characteristics.
5.2.8. Conduct marketing, statistical and other research based on impersonal data. Data from the data specified in item 2.7. data collection systems in impersonal form are collected and analyzed to find out how much time Users spend in various sections of the Application, their interests and preferences.
5.2.9. Compliance with the requirements of the law. As the organizer of the dissemination of information on the Internet, Global Flowers stores information about the facts of reception, transmission, delivery and/or processing of written text, images, sounds, video or other electronic messages of Internet users and information about these users for one year from the end of such actions.
6. Rights of the User in relation to Personal Information
6.1. If required by applicable law, the User shall have the right to:
6.1.1. Receive information about the collection and use of his personal data.
6.1.2. Access and correct your personal data if it is incorrect or incomplete.
6.1.3. To prohibit the processing of their personal data if their accuracy is disputed, processing is unlawful, as well as in cases where Global Flowers no longer requires personal data for the purposes in which they were processed by Global Flowers.
6.1.4. To object to the processing of their personal data, as well as to prohibit their processing in cases where Global Flowers processed them when performing tasks in public utility or in their own legitimate interests, and there is no forced need to continue such processing.
6.1.5. At any time withdraw the consent that the User has provided for processing of his personal data. If the User revokes its consent to the processing of personal data, such revocation will not affect the validity of the processing that Global Flowers made on the basis of such consent prior to its revocation.
6.1.6. Require the deletion of their personal data in cases where it no longer relates to the purpose for which it was collected or processed; when consent is withdrawn and Global Flowers has no reason to continue processing; when there are objections to further processing in the public or legitimate interests of Global Flowers and there is no forced need to continue such processing; when personal data was improperly processed.
6.1.7. Not be subject to a decision based solely on automated processing, including profiling, which has legally significant consequences for the User or otherwise affects in the same way, unless there is a legal basis for continuing processing.
6.1.8. Obtain personal data in structured, widely used, and machine-readable form to be able to transfer data in cases where Global Flowers processes the provided personal data by automated means.
6.2. These rights can be realized by using the tools that Global Flowers offers in the Appendix or by sending a special request to Global Flowers in the ways described below. Global Flowers will respond to any such requests in a timely manner in accordance with applicable law. In some cases, Global Flowers may ask the User to go through the identification procedure before processing the request. The user may contact the appropriate supervisory authority in their jurisdiction if Global Flowers does not respond.
7. Storage of Personal Information
7.1. All Personal Information collected shall be held only for a period that is necessary to achieve the purposes in which such information was collected or for a period permitted or required by the applicable law. From time to time, Global Flowers checks data processing systems to determine whether the goals of collecting and processing user personal data remain valid. Such determination is based on a number of factors that include, but are not limited to, whether the User maintains a relationship with Global Flowers, whether Global Flowers has fulfilled the User's requests (including any additional tasks), whether there is a contractual relationship between the User and Global Flowers, and whether there are contractual or legal grounds for continuing to store the User's personal data. Based on the results of such verification and notifications received from personal data subjects, Global Flowers updates its systems.
7.2. In order to improve the quality of the Service and to ensure the possibility of legal protection, Global Flowers may store log files about actions performed by the User within the framework of the Application and/or the Service, as well as in connection with the conclusion and execution by the User of the Agreement and other agreements on its part, within 1 (One) year from the moment of their execution.
8. Personal Information Protection Requirements
8.1. Global Flowers stores Personal Information and protects it from unauthorized access and distribution in accordance with internal rules and regulations.
8.2. The User's Personal Information shall be kept confidential except for publicly available information (Clause 2.4. this Policy) and other cases when the technology of the Application or the Service provided on its basis or the settings of the software used by the User provide for the open exchange of information with other Users of the Application or with any users of the Internet.
9. Transfer of Personal Information
9.1. Global Flowers may transfer Personal Information to third parties in the following cases:
9.1.1. The User has expressed its consent to such actions, including cases when the User applies the settings of the used software, which do not limit the provision of certain information;
9.1.2. Transfer is required as part of the User's use of the Application functionality and/or the specifics of the Service based on it;
9.1.3. In connection with the transfer of the Application to the possession, use or property of such third party, including the assignment of rights under contracts entered into with the User to such third party;
9.1.4. At the request of a court or other authorized state body within the procedure established by law;
9.1.5. To protect the rights and legitimate interests of Global Flowers in connection with the violation of agreements concluded with the User.
10. Change and delete Personal Information
10.1. The User may at any time independently edit in his Personal Account the Personal Information provided by him during registration or authorization.
10.2. The User has the right to remove his/her account or to exercise the right to revoke consent to processing his/her personal data by sending a request to Global Flowers to delete his/her account at [email protected].
11.1. This Policy may be amended or terminated unilaterally by Global Flowers without notice to the User. The new version of the Policy shall take effect from the moment it is posted on the Global Flowers Website, unless otherwise provided by the new version of the Policy.
